Why this privacy statement?

XWIFT attaches great importance to protecting your privacy and personal data. We only use your personal data in accordance with the Privacy Act and other relevant current legal regulations. Any reference in this Privacy Statement to the Privacy Act means a reference to the Act of 8 December 1992 on the protection of privacy with regard to the processing of personal data. Any reference to the Regulation is a reference to the Regulation of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

With this Privacy Statement, XWIFT wants to inform you of any processing operations with regard to this data and to your rights. By using our platform/website/application, you explicitly consent to possible processing operations by XWIFT.

This Privacy Statement may be subject to changes and changes in the future. It is up to you to consult this document on a regular basis. Any substantial change will always be clearly communicated on the XWIFT platform.

For what purposes is my personal data used?

XWIFT collects personal data to provide you with a safe, optimal and personal user experience. The collection of personal data expands as you make more intensive use of the website and our online services.

Data processing is essential for the operation of the website and the associated services. The processing takes place exclusively for the following specific purposes:

  1. Providing and improving a general and personalized service; including billing purposes, offering information, newsletters and offers that are useful and/or necessary for you, obtaining and processing user reviews and providing support.
  2. Marketing purposes.

When you visit the XWIFT website, some data is collected for statistical purposes. Such data is necessary to optimize the use of our website. This data is: IP address, probable place of consultation, time and day of consultation, which pages were visited. By visiting the XWIFT website, you agree to this data collection for statistical purposes as described above.

The User always provides the personal data to XWIFT himself and can thus exercise certain control. If certain information is incomplete or apparently incorrect, XWIFT reserves the right to temporarily or permanently postpone certain expected actions.

The personal data is only processed for internal use within XWIFT.
We can therefore reassure you that personal data will not be sold, transferred or disclosed to third parties associated with us. XWIFT has taken all possible legal and technical precautions to prevent unauthorised access and use.

What are my rights?

Guarantee of lawful and secure processing of personal data

XWIFT always processes your personal data fairly and lawfully. This includes the following guarantees:

  1. Personal data will only be processed in accordance with the described and legitimate purposes of this Privacy Statement.
  2. Personal data is only processed insofar as it is adequate, relevant and not excessive.
  3. Personal data will only be kept for as long as necessary to achieve the purposes described and justified in this Privacy Statement.

The necessary technical and security measures have been taken to minimize the risks of unauthorized access to or processing of the personal data. In the event of a breach into its IT systems, XWIFT will immediately take all possible measures to minimize the damage.

Right to access/rectification/erase your personal data

Upon proof of your identity as a User, you have a right to obtain an answer from XWIFT as to whether or not your personal data is being processed. When XWIFT processes your data, you also have the right to view the personal data collected. If you wish to exercise your right of access, XWIFT will comply within one (1) month of receiving the request. The request is made by registered mail or by sending an email to info@xwift.be.

Inaccurate or incomplete personal data can always be improved. It is up to the User to correct inaccuracies and omissions himself in the first place. You can exercise your right to improvement by providing an additional statement to XWIFT. XWIFT will comply with this within one (1) month of receiving the additional statement.

You also have the right to have us erase your personal data without unreasonable delay. You can only invoke this right to be forgotten in the following cases:

  1. When the personal data is no longer necessary for the purposes for which it was originally collected;
  2. When the personal data was collected on the basis of consent obtained and no other legal basis exists for the processing;
  3. When an objection is made to the processing and there are no overriding legitimate grounds for the processing;
  4. When the personal data has been processed unlawfully;
  5. When the personal data must be deleted in accordance with a legal obligation.

XWIFT assesses the presence of one of the aforementioned cases.

Right to restrict/object to the processing of your personal data

User has the right to obtain a restriction on the processing of your personal data:

  1. During the period that XWIFT needs to verify the accuracy of the personal data, in case of dispute;
  2. When the data processing is unlawful and the User requests that the processing be restricted instead of erasing the personal data;
  3. When XWIFT no longer needs the User's personal data for processing purposes and User needs the personal data in connection with a legal claim;
  4. During the period that XWIFT needs to assess the presence of the grounds for deleting personal data.

In addition, the user has the right to object to the processing of his personal data at any time. XWIFT will then stop processing your personal data, unless XWIFT can demonstrate compelling legitimate grounds for processing your personal data that outweigh the User's right to object.

If User wishes to exercise these rights, XWIFT will comply within one (1) month of receiving the request. The request is made by registered mail or by email to info@xwift.be.

Right to data portability

User has the right to obtain the personal data provided to XWIFT in a structured, common and machine-readable form. In addition, the User has the right to transfer this personal data to another controller if the processing of the personal data is solely based on the User's consent.

If User wishes to exercise this right, XWIFT will comply within one (1) month of receiving the request. The request is made by registered mail or by email to info@xwift.be.

Right to withdraw my consent/right to file a complaint

User has the right to withdraw consent at any time. Withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal. In addition, the User has the right to file a complaint regarding the processing of his personal data by XWIFT with the Belgian Commission for the Protection of Privacy.
